According to the <a href="http://portal.hud.gov/portal/page/portal/HUD/press/press_releases_media_advisories/2010/HUDNo.10-016" target="_blank">press release</a>, the &#8220;new&#8230;]]></description>
			<content:encoded><![CDATA[<p>Last week the <a href="http://portal.hud.gov/portal/page/portal/HUD/federal_housing_administration" target="_blank">Federal Housing Administration</a> (a.k.a. FHA) announced changes to their lending guidelines that all Massachusetts first-time home buyers should be aware of. According to the <a href="http://portal.hud.gov/portal/page/portal/HUD/press/press_releases_media_advisories/2010/HUDNo.10-016" target="_blank">press release</a>, the &#8220;new measures will help FHA better manage risk, while maintaining support for the housing market and access for underserved communities&#8221;. But what does that mean to you or me?</p>
<p>We asked mortgage advisor <a href="http://www.craigtashjian.com/" target="_blank">Craig Tashjian</a> for some clarification on changes that may affect buyers and sellers of Massachusetts homes:<span id="more-4969"></span></p>
<p><strong>Increased Mortgage Insurance:</strong><br />
The FHA up front mortgage insurance premium (commonly referred to as private mortgage insurance or PMI) is increasing.  The current rate is 1.75% of the loan amount and the new rate will be 2.25% of the loan amount. This is a significant increase which will cost consumers hundreds of dollars.</p>
<p><strong>New Down Payment &amp; Credit Score Requirements:</strong><br />
Under the new policy, home buyers who have a credit score of at least 580 may still be able to purchase a home with 3.5% down. However, those with credit scores of less than 580 will be required to put down at least 10%.</p>
<p><strong>Reduced Seller Concessions:</strong><br />
FHA has also decreased allowable seller contributions toward settlement costs from 6% to 3% of the purchase price. This means that the seller will only be able to offer the home buyer 3% to help defray closing costs, as opposed to 6% under the current policy.</p>
<p>A real-life example&#8230;last year we negotiated a deal for first-time home buyers in an FHA rehab loan that resulted in almost 6% of the purchase price back at closing. Part of the money was used to significantly buy down their rate and the rest towards pre-paids, etc. I strongly doubt they would have been able to buy under the new regulation of 3% max seller concessions.</p>
<p>In addition to these changes, the new policies contain a series of new measures aimed at increasing lender enforcement.</p>
<p><strong>The changes will become effective on April 5, 2010.</strong></p>

			<content:encoded><![CDATA[<p>It doesn&#8217;t take a real estate genius to figure out that November&#8217;s <a href="http://claytonrealtygroup.com/ma-real-estate-market-nov-09/">record breaking home sales</a> numbers represent a whole lot of folks cashing in on the (old) homebuyer tax credit before it expired. Of course, the not-so-funny joke was on them since the credit was quickly extended AND expanded with the passage of <a href="http://www.govtrack.us/congress/bill.xpd?bill=h111-3548&amp;tab=summary" target="_blank">H.R. 3548</a>. Most real estate agent types were pretty confident it would get extended but feel that this is it. No really, for real this time. I tend to agree that another extension is unlikely but anything is possible. Either way, we&#8217;re still getting questions from folks so here are the basics.</p>
<p><strong>First-Time Homebuyers:</strong><br />
First-time homebuyers (that is, people who have not owned a home within the last three years) may be eligible for the tax credit. The credit for first-time homebuyers is 10% of the purchase price of the home, with a maximum available credit of $8,000.<span id="more-4828"></span></p>
<p>Single taxpayers and married couples filing a joint return may qualify for the full tax credit amount.</p>
<p><strong>Current Owners:</strong><br />
The tax credit program now gives those who already own a residence some additional reasons to move to a new home. This incentive comes in the form of a tax credit of up to $6,500 for qualified purchasers who have owned and occupied a primary residence for a period of five consecutive years during the last eight years.</p>
<p>Single taxpayers and married couples filing a joint return may qualify for the full tax credit amount.</p>
<p><strong>What are the New Deadlines?</strong><br />
In order to qualify for the credit, all contracts need to be in effect no later than April 30, 2010 and close no later than June 30, 2010.</p>
<p><strong>Tax Credit vs Tax Deduction</strong>:<br />
It’s important to remember that the tax credit is just that… a tax credit. The benefit of a tax credit is that it’s a dollar-for-dollar tax reduction, rather than a reduction in a tax liability that would only save you $1,000 to $1,500 when all was said and done. So, if a first-time homebuyer were to owe $8,000 in income taxes and would qualify for a tax credit of $8,000, she would owe nothing.</p>
<p>Better still, the tax credit is refundable, which means the homebuyer can receive a check for the credit if he or she has little income tax liability. For example, if a first-time homebuyer is eligible for a tax credit of $8,000 but is liable for $4,000 in income tax, she can still receive a check for the remaining $4,000!</p>
<p><strong>Higher Income Caps:</strong><br />
The amount of income someone can earn and qualify for the full amount of the credit has been increased.</p>
<p>Single tax filers who earn up to $125,000 are eligible for the total credit amount. Those who earn more than this cap can receive a partial credit. However, single filers who earn $145,000 and above are ineligible</p>
<p>Joint filers who earn up to  $225,000 are eligible for the total credit amount. Those who earn more than this cap can receive a partial credit. However, joint filers who earn $245,000 and above are ineligible.</p>
<p><strong>Maximum Purchase Price</strong>:<br />
Qualifying buyers may purchase a property with a maximum sale price of $800,000.</p>

			<content:encoded><![CDATA[<p>Last week the <a href="http://www.marealtor.com/" target="_blank">Massachusetts Association of Realtors</a> (a.k.a. MAR) released their housing market data for the month of November highlighting a record 63% increase in single-family home sales as compared to <a href="http://claytonrealtygroup.com/market-update-nov-2008/">November 2008</a>. Condominium sales also set a record with a 76% increase over last year. WOW! Median prices remained fairly consistent with last year but the number of homes put under agreement rose 15%, the 6th month in a row pending sales have gone up.</p>

<p><strong>Pending Sales:</strong><br />
The number of single-family homes put under agreement in November was up 15% compared to the same time last year (2,952 homes in 2008 to 3,387 homes in 2009). On a month-to-month basis, single-family homes put under agreement were down 27.2% from 4,652 homes in October. The number of condos put under agreement in October was up 19% compared to November 2008 (1,119 units in 2008 to 1,379 units in 2009). On a month-to-month basis, condos put under agreement were down 30.5% from 1,983 units in October. Pending sales or sales “under agreement” are homes that have a signed purchase and sale agreement, but have yet to close and be recorded.</p>
<p><strong>Inventory and Days on Market:</strong><br />
The inventory of single-family homes as of November 30, 2009 decreased 15% from November 2008 (28,607 listings in 2008 to 24,788 listings in 2009) which translates into 6.5 months of supply in November 2009. This is down from 12.2 months of supply last year and down from 7.1 months in October. November supply was at its lowest since November 2004. The November peak was 35,254 homes in 2006. This is the 20th straight month that inventory has gone down compared to the year before.</p>
<p>The condominium market saw November inventory decrease by 14% from last year (11,983 listings in 2008 to 10,313 listings in 2009), which translates into 6.5 months of supply, which is down from 13.2 months in November 2008 and down from 7.3 months this past October. This is the 20th straight month that inventory has gone down compared to the year before.</p>
<p>Detached single-family homes stayed on the market an average of 116 days in November 2009 compared to an average of 137 days in November 2008, while condos stayed on the market an average of 128 days, down from an average of 149 days in November 2008. On a month-to-month basis, days on market for single-family homes were down from 126 days and condos were down from 137 days in October.</p>
<p>MAR President Gary Rogers stated:</p>
<blockquote><p>The record sales gains in November show that the first-time homebuyer tax credit was successful in getting buyers off the fence and back into the market. We have now had five straight months of positive sales activity. With prices staying essentially level from last year along with the expansion of the tax credit to all buyers, we hope for continued improvement. Then we can feel confident in saying the market has stabilized.</p></blockquote>
